Expert Witness Experience
Our expert witness experience began with two significant legal cases, which began in 2014. In total, these cases resulted in a total of 490 billable hours:
- Financial Conduct Authority v Alberto Micalizzi, Upper Tribunal Tax and Chancery Chamber, Reference No FS/2012/0016. Report submitted February 2014; Deposition March 2014 (see 2015 FCA enforcement action and Tribunal judgement)
- DD Growth Premium Master Fund (in Liquidation) v BNY Mellon Services (Ireland) DAC, High Court of Ireland, Record No 2014/5675P; Initial Report October 2015; Mediation March 2019
The first case required a single expert report, with the deposition being held in the Upper Tribunal Tax and Chancery Chamber in London in 2014. The tribunal's conclusions and comments on our expert opinion are a matter of public record and can be found via reference to the above link, located at: http://taxandchancery_ut.decisions.tribunals.gov.uk/Documents/decisions/Micalizzi-v-FCA.pdf.
The second case was settled prior to being heard in the High Court of Ireland via a mediation in 2019; over a five year period, we prepared a series of expert reports, which included independent calculations for the values of complex OTC options and other illiquid assets plus a calculation of a claim for damages, culminating with responses to and negotiations with the opposing experts.
